After running a small franchise business for 15 years, I’ve joined a boutique firm and am working to build a law practice. My focus areas are franchise law, startups, and Trademarks. I have big firm experience but almost no experience setting my own prices. Working with a boutique firm now and we flat fee many things. I’m setting up some services that I can flat fee, but have no idea how to price them. Can anyone provide some advice on what is fair, but profitable?

Do your hourly times the average time it would take you for the more routine matters. For the franchise matters, I can imagine it would truly depend how big the project is, but price that depending on the matter. For example if it is going to take you 20 hours, and your hourly is $300, it will be $6000 fee for the scope of work you anticipated.

Advice for Of Counsel roles? How normal is it to be pulled off a trial team because you tell your boss you are moving after trial? I have a trial coming up first week of Oct. This case has been my baby, and I’m going to try it with my boss. I tell my boss up front that, for family reasons, I’ve gotten a new job and will be moving to another city two weeks after trial will likely end. 3 attorney firm. I’ve been here for 6 years and have used Westlaw exclusively. Now we are switching to Lexis because apparently Westlaw is too expensive. I hate change. I know where everything is on Westlaw and now I need to relearn. Apparently Westlaw will not budge on price and would rather just see a client leave than work with them. Super annoying. Any insight on negotiating Westlaw or transitioning to lexis?

I believe improving one’s sales conversion rate is something everyone want to improve but no one wants to admit they would like to work it. Funny how lawyers will spend thousands on seminars to improve trial skills. But this topic is not discussed in our profession. I have read books in sales. But am unable to find any for lawyers. We are a firm of 5 transactional attorneys and the bonus structure is very unclear. The usual “based on personal performance and firm profitability” language. I wonder how this is calculated in general. What is the percentage bracket of the bonus? Assume it is a high performance 9+ year attorney and the firm is profitable (even with COVID). The based salary is low $120k. Firm is in Tx. I’d love to hear your comments.

Former client( filed a bar grievance that was dismissed, sent me a demand letter that an attorney responded to on my behalf, and filed a BBB complaint against my non-BBB law firm) has now pro se filed a lawsuit against me in small claims court. Alleging misrepresentation, failure to file a lawsuit, and failure to advise during the process. I have phone logs, emails, and billing notes (all of which she has) that show she’s lying. Should I notify my malpractice carrier? All advice appreciated!
