Are non competes enforceable against New York lawyers? I was asked to sign one, but thought that was against Rule 5.6 and not enforceable.

I thought non competes were not enforceable at all except for very narrow exceptions

I believe not only are they unenforceable, it’s an ethics violation to even enter into one as an attorney. At least that’s the case in NJ.

Working on some law firm applications tonight and it sucks that I know that I am so capable and have a strong work ethic but firms can’t see beyond grades or the fact that I didn’t go to a t14 law school or prestigious undergrad. Associate at an AmLaw 100 firm doing patent work. I applied to a part time masters program to try to pivot to a different technical field (still doing patent work, but in something that interests me more than what I’m doing now). Do I try to stick it out at the firm while getting the masters, ask for a reduced hours schedule, or get a part time, non-legal job so I can focus more on the program (one year).

For those working in house, how much “from scratch” document drafting are you doing vs. reviewing and revising “outside documents”. For example, if your company wants to enter into a joint venture company with another entity, are you drafting the company agreement “from scratch” or is it based on internal forms? Hello, hoping for some input on how to time a job change. At a startup - we are doing well now but unless we have complete turnover in management I don’t think we have a bright future post-COVID. I could coast here 1-2 years before having to look. I’ve been here for a little under a year. This is my second in house job after 10 years at the same firm. The market is hot now, probably won’t be in 1-2 years and I am getting interest for good roles. OTOH I don’t want to look like a job hopper.

NFW- I just had a good laugh. Earlier today I was on a video conference call reviewing a Private Label Agreement template with a larger company who wishes to brand label products we develop and manufacture. We came to a very one-sided provision and my sales VP stated “for this one, how can we just say ‘hell no’ ...nicely?” The other person on the call said we can replace the wording with just NFW (no f@$* way) and I said “I will have to add that to the defined terms section so it’s clear”
