Are there many legitimate ethical hurdles when switching from insurance defense to plaintiff’s work? I’ve always seen myself as a plaintiff’s lawyer, but ultimately took an ID job out of law school (better salary, no real opportunities at plaintiffs firms that I liked). I like what I do—so far—but I’m constantly thinking about whether the grass is greener.

You can’t work on cases you worked on at the defense firm. Other then that you are fine. Many plaintiffs lawyers did insurance defense early on.

My bosses were both ID in the beginning before starting Plaintiff's work. It made them both great litigators. You can represent cases against former clients if they are insurance companies and you never represented them against YOUR client. Like, If you represnted State Farm against claims brought by Ms. Anderson, you couldn't just switch and represent Ms. Anderson. You could, however, represent Mr. Moore for claims he wishes to bring against State Farm because you have never been a part of State Farm's legal team against Mr. Moore.

What are your thoughts on pay discrepancies based on family structure? Ex. Two people do the same job but one is paid more or given a larger bonus “because they have kids and you live alone” or “because their family is struggling”. Is that an ethical factor if both employees do the same job at the same pace, quality, etc?

Are you aware of the CPA exam credit extension to 2021 for NY CPA candidates impacted by COVID19? It’s on a person-by-person basis and you need to request the extension. Has anyone tried doing this yet? Can anyone shine more light on this? In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.

I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. I hate this profession/career more and more each year. Has anybody been successful breaking off on their own in recent years? Advice?
