It’s fun to get a witness who just doesn’t know how to be deposed, and keeps talking and talking with excellent quotable material for summary judgment.

I enjoy anything I can bill for, except discovery requests.

I love second-chairing depos because of this. Sure, the prep can be a nightmare, but then I get to bill for 8+ hours of passing exhibits and taking notes.

Old Dog contribution ... find a way to like it. Good dep skills are a huge opportunity to be valuable to the senior attorney on the case and — done correctly — great prep for trial examinations. Of course, I have fouled my share of deps too. Cannot be a great litigator without great dep skills. Period.

“Enjoy” is a bit aggressive. I enjoy having a drink on the beach. But as far as lawyering goes, it’s pretty fun (once your prep is done). Gives you a chance to face people and cut through BS and posturing, and have some fun.

Covered a managers meeting for her yesterday, was with some senior members of the marketing team. A director opens the call with “we are so sorry about the impacts the layoffs have had on your teams today…” then noticed I was in the call and said “we are still notifying others so best to keep it under the radar” …25% of my team was let go three hours later with no warning😬

What is more stressful: ID or Big Law Commercial Lit?

When OC is rude/aggressive/uncivil in an email (and the behavior is unprovoked), what’s the best way to respond? I usually ignore it and respond normally, but I won’t allow older attorneys to think that, just because I’m a young lawyer, they’re going to walk all over me. I’m still a lawyer with the same degree and younger lawyers know A LOT of stuff that many experienced attorneys do not (technology, doc management systems, how to edit and mark docs without cutting down the Amazon etc.)

Is the goal always to make partner? I’m looking to get out of ID and am interviewing for a remote PI position. The pay will be much higher and I’ll enjoy the work more but I’m not sure if the partner track when the firm is in another state. Should this matter?

Florida resident here. My landlord listed the condo we live in a month ago. We move out end of May. For the last month, we have had multiple tours a week. I'm starting to feel like I live in a museum and there's no end in sight for these tours. I asked the the realtor to pick certain days a week for tours and he said no. Is it possible to have an off day with billable hours? Corner office is always concerned about our mental health “in these trying times” yet the not-so-subtle “I noticed your hours went down this week” convos undermine that. Even if my hours are down from 2 weeks ago but still over 40 billable.

Number 1 pet peeve of junior associates is not getting me work by the date they said they would, or communicating that they either can’t get to it or it would be late. I’ve been guilty of it myself a lot in the past and now that I’m delegating work, I see how infuriating it is. I hate micromanaging but I see why people do it now, because they’ve been burnt too many times.

About 6 months in as an associate in primarily commercial litigation. Have a feel for billable time on some matters, but certain types of motions or discovery requests I have almost no clue the “expected” time for something to be billed. Sometimes the partner will tell me an estimated time, but often they won’t. Is there a “cheat sheet” of sorts anyone has in terms of common billing times? I’m a mid-level associate at a a large law firm. I work in a regulatory practice group that occasionally requires me to work on litigation matters. Unfortunately, I was never really trained on memo writing earlier in my career, and now I’m supervising more junior associates with no idea what I’m doing. I was and am a pretty good writer, but I get bogged down by the importance of citations in the drafting process. Any tips from experienced litigators on how to best to put together initial drafts?

Why does everyone try to introduce themselves first on courtcall? During physical appearances- prosecutor/plaintiff/petitioner always goes first. Half of courtcall hearings are spent sorting through the chaos that ensues when any counsel strays from this.
