Hello Everyone,

I am starting a new job as a Behaviorist as an independent contractor (1099). I have always done this work so I am familiar with being paid once a month. But withholding 2 weeks of pay each month is a bit bizarre to me. The DOE pays the agency for all hours worked on the 1st of the month. I asked what is her reason, she said just in case contractors claimed hours they did not work and it has to be paid back. There’s an administrator who signs off on your timesheet.

How can anyone claim hours they did not work when the principal signs your timesheet. I said invent a clock in system then because it’s not fair to hold 2 weeks of someone’s pay every month. Is this legal?

Do you eventually get paid the money they withhold?? I’m confused as to how they can do this. Wouldn’t labor laws forbid this??
