Helping a friend in NY— parking lot damages car and offers to use their body shop recommendation (pretty far and inconvenient for my friend, also skeptical of recommendation). My friend provided an estimate of their own body shop. Parking lot is only offering a tenth of the price to fix it. Any suggestions on how you would put the pressure on them? Are they obligated since they’re offering an alternative remedy?

No they’re not obligated. Send them a certified and regular mail letter telling them they have X amount of days to respond. They can either pay the amount of the first estimate or obtain a second estimate from a reputable body shop in the area. Tell them you’re going to file a complaint after the amount of days pass.

HR opinion: Do I have any leverage as a hospital nurse case manager in negotiating earned time? I have 15 years within the organization, left for 10 months to be remote during the pandemic while sorting out childcare as immunocompromised family helped. Former client( filed a bar grievance that was dismissed, sent me a demand letter that an attorney responded to on my behalf, and filed a BBB complaint against my non-BBB law firm) has now pro se filed a lawsuit against me in small claims court. Alleging misrepresentation, failure to file a lawsuit, and failure to advise during the process. I have phone logs, emails, and billing notes (all of which she has) that show she’s lying. We are a firm of 5 transactional attorneys and the bonus structure is very unclear. The usual “based on personal performance and firm profitability” language. I wonder how this is calculated in general. What is the percentage bracket of the bonus? Assume it is a high performance 9+ year attorney and the firm is profitable (even with COVID). The based salary is low $120k. Firm is in Tx. I’d love to hear your comments.

I work at a small, 3 lawyer firm. One of the lawyers is not barred in the state we practice. Because of this, the managing attorney has been having him draft motions and other legal documents and use my name and bar number and having me file them because I will have to appear in court for the matter. Is this normal? I am not provided time to review the materials before I file them so I end up working longer days because I am nervous to file something using my name and bar number.
