You might be able to negotiate something, just don't rely on it.
Had the same problem - discussed it with my partner and he allowed me to choose my own timeframe for the resignation.
Okay, that’s actually quite good then.
This will vary by firm and practice.
We have a 90 day notice period for managers, but I've not seen it enforced. Each manager I know who has left just had a conversation with leadership and worked out an appropriate timeline (usually around a month, but I've seen as little as two weeks).
Yeah this sounds about right also. If they want to put you on garden leave anyway rather than keep you going, it’s better to terminate your employment in terms of cost and access to things
Ahh okay good points everyone. If I leave then will I have to serve the notice period by garden leave?
Meaning would I need to sit at home and wait to join the next firm?
Honestly? Who knows! You have to start the conversation with them. The end date and whether you actually work or not is their discretion.
Does the original firm let you leave sooner?
Is the notice period enforcable by law in the UK?
Yes but you have to assess whether it’s worth enforcing in terms of cost, effort and relationships. It’s a pragmatic call. If someone has 3 month notice you may well be quite senior and have useful IP or clients, this may make them want to rely on it.
This is just purely in terms of enforceability not any individual negotiation, by the way.
If you’re going to a rival firm. Depending on your level. They may put you on garden leave. Paid time away from current employer but unable to start at new employer. This acts as a fire stop for data access etc.
