If someone’s rising at work because of favoritism—and you’re constantly overlooked… do you walk away, speak up, or call a lawyer? You can’t prove it’s about race, but you are the only Asian on the team. When does it stop being shady and start being lawsuit-worthy?

A combination of the three, but mostly on walking away really. The lawsuit route needs lots of proof, but they’ll also probably have enough proof on your performance as well. Even small mistakes here and there can be pointed out as potentially major and detrimental to the business, so that’s hard to counter-argue. If they have two people with similar performance, they can easily find ways to justify why one deserves the promotion more than the other. In terms of speaking up, I’d do it just to remind them that you are there and see what they’re doing, just in case it gets them to reflect that if they don’t also promote you, you could potentially leave. They shouldn’t get comfortable with the idea that you’ll just take that type of gaslighting and breadcrumbing from them. But ultimately, the walking out strategy is best because by this point you’ve already figured out what their mind and their soul is like, so it’s unlikely they’ll change or that they won’t do this again. Toxicity is very difficult to stamp out in organizational culture and the people that perpetuate it.

Considering you can only control your own actions, I would take a long look at what you could/should do yourself before pointing fingers or chasing any formal complaints. Performance isn’t always about the quantitative results - it’s also about how you are as a colleague. I worked with someone who consistently hit their numbers but lacked soft skills, was abrasive and rude, so no one wanted to work with them, and as a result didn’t get the same opportunities the supposed “favorite” of their manager deserved.

I recommend finding a different company that values you and is more in line with your core values. Lawsuits are hard if you haven’t been fired and demoted and specifically heard someone say (or preferably have in writing) something anti Asian. It’s better for your mental health to walk away. They don’t deserve your talent

Is it just you that sees the favoritism or is it multiple people in your organization? I ask because sometimes we get into our own heads too much sometimes about why someone else may be moving up the ladder. Because we are disgruntled, we see things through a darker lens than others. Our mood dictates how we perceive EVERYTHING going on around us.
If you are in a right-to-work state, you can almost never prove racism. There has to literally be something in writing that another coworker is willing to give to you that would show something like this. I wouldn't hold my breath for that.
Other ways you can go about finding out how to move up in your company:
1) Find out if there is a rubric to follow. For example, in tech companies there are set goals for engineers to be able to move up the ladder.
2) Ask the "favorite" for a meeting and find out what they have done to make steps up in the company. There might be a lot you don't know. This person could be putting in a lot of extra personal growth work in order to be promoted.
3) Sit with your supervisor. Express EXACTLY what your goals are and ask them is they can help you build a plan to reach those goals.
4) If no one will do any of the things above, then start looking for another position, quietly. Never speak poorly of anyone at your current company. Don't let potential employers prompt a conversation in that direction either. People will do that. I know that I do that when interviewing with companies. How easy do they talk about their employees? Is it positive or negative? Its very telling.

For something to be worthy of a lawsuit, you'll need to have actual evidence. And that probably won't be easy to obtain. You can document interactions you feel don't go your way, but the issue will be whether you could prove a pattern of discrimination. Your best strategy is probably to talk to an employment lawyer and see if they think you've got any options in that regard.

If you file a law suit and you are wrong, to can be considered litigious and this can spread.

Hot topic here! As others have said, I would document everything but be careful about certain things (such as recording since some states have laws against that).

I think that workplace favoritism may be really annoying; everyone deserves to be valued for their abilities rather than their personal preferences.

You'd have to get hard evidence that you're being held back only because of race. If there's a constant pattern of Asians being held back at that company, that MIGHT be enough.
It's a sad fact that people generally overvalue themselves and their own contributions compared to others. I'd suggest you do some honest self-evaluation and raise your concerns to HR and have them explain why before you play the race card. If you don;t like what you hear then you can choose to walk.

Yes, this was brought to my attention initially by coworkers to me, I never realised this was happening at the beginning.. Suddenly these coworkers were reomoved from work, since the corrupt Manager found out they new, so they cleverly got rid of them. I stayed quite and then saw what was happening, it was absolutely amazing, the sexual favours, money in tins given and alot more. And there are even more incidents that would blow your mind (literally), yes I have been thinking oif compoliing evidence and have some and other evidence, and to get even more evidence from ex JLR employees would make a fantastic case for Tata and National Press. I would first run it through it with three different lawyers and then if they say it is ok go straight to Tata and National press if I was you. These practices need to be highlighted to all in UK..

Interviewing at a dream company, and right from the first interview the recruiter told me we are way off on salary expectations. This was a little bit expected, as the role is requiring a few years less experience than I have and also in a much cheaper market. Currently I work for a small company that does the construction of small cell utility poles and roof top sites for the major cell carriers like VZW, T-mobile, AT&T and so on. I am a project coordinator but I do everything under the sun. Created project tracker. Im a pastry cook with 4yrs experience and the average salary start for this position is now at $22/hr here in vegas, especially in the strip. But cooking/baking is not my passion.
