It doesn’t sound like you want to absorb their book. You can help find your replacement and then bounce but if it’s not your firm, then it’s not your responsibility to take care of everyone.
If that big book of business is passed to you, do you still have to originate?! My thought is take the book and hire someone you trust and is capable to work on it and you can take a breather. While in house can be great, there are also downsides. Jobs aren’t all created equally and litigation specific jobs are hard to come by. Is there any set up that would make you want to stay? If not, then you have your answer.
One point to consider - is your in-house position insulated from the economy? In other words, what is the likelihood your position would be eliminated if the company isn’t doing well?
Also, if the company IS doing well, then gets acquired by a bigger company, the Legal team of the acquired company will likely be sent packing.
You could start having this conversation with the team and be open about it.
unless you have some personal tie to the firm, as in the Partner is your friend, family or family friend, I would decline. only 10years of experience and you are inheriting a book? it looks like you are in a niche area of law or small town, in which case, it may be beneficial for you to take over
Once the business is yours, hire another lawyer to do all the work and just be the name on the door. Win win!
Similar situation but w/ out a book to inherit. Curious to hear what you decide!
Consider staying and hiring a senior associate or counsel wanting to step into a partner role and allowing that person to absorb the book. I would expect that within a year or two, that person would be established. In the interim, if you are going to bounce anyway, that rainmaker pressure wouldn’t hit very hard. Just look for your perfect gig and bounce if the pressure gets to be too much, which I wouldn’t really expect since you and/or the other person are taking over a book anyway.
