Former insurance defense attorney: I actually disagree. Unless it’s a first party case, the insurance company is not your client. The insured is your client. So no rule is being broken.
I thought it was bad form for Plaintiff’s attorneys to go around me (especially because I was often trying to get insurance companies to pay a reasonable amounts to protect the insured) but it wasn’t against the rules.
Do you represent the insurance company itself or an insured?
Makes the difference whether it’s a clear rule violation or just unprofessional and discourteous.
Is this a common practice with this PI attorney or firm in particular or just in this case?
The attorney may be being pressured to get it resolved as quickly as possible thinks going through the adjuster is the fastest way to get there.
