Several months into my firm job after a district court clerkship. Currently mulling applying for a circuit job. My question: what is the protocol for submitting an opinion (or portion of an opinion) I wrote as a writing sample? It would be one that went without any edits from my judge. This is assuming my judge is cool with the idea (they’re one of the nicest people alive so I assume so). Is this a thing?

When in doubt always ask your judge.

like

When I clerked, it was fair game if the opinion was public record and represented your unedited work. If you really want to be safe, just ask your judge for permission.

like

dont, absolutely not a thing

Lol it absolutely is a thing. Both my district judge and my circuit judge allow the use of ops as writing samples. Likely that they’ll require redaction though. Just ask your judge’s preference.

Completely depends on the judge. My COA judge point blank did not allow use of opinions as writing samples. Just ask.

It worked for me. The judge that I clerked for really pushed it to me, and they pulled out opinions that I worked on that they suggested I send as samples. You need their permission first, and some judges don’t want to see opinions as writing samples.

I’ve been at my clerkship for 5 years (4 with a different judge) and one with my current judge, and I heard horrible things about him before starting, but I assumed they were exaggerated. Turns out they’re all true, and I’ve had to start therapy to deal with him and the incredibly toxic environment. I’m trying to get out ASAP b/c he also has a history of firing clerks without cause or notice, but I think I’ll only be able to give two weeks notice if i get the job I’m interviewing for. Thoughts?
