It can already draft half decent claims, make arguments against rejections, etc. It might not make the job completely obsolete as you should always have a human review/edit and you may need a human to step in to draft. However, this will require fewer attorneys and I’m sure most will be in house. Not to mention that the cost for our services will dramatically go down.

I gave ChatGPT random prompts for fun to see how it would handle claim drafting and responding to arguments. The claims weren’t perfect but they were a good start and it even added subject matter to fill in gaps in how the invention would work. Makes sense….it learned the style of other claims directed to similar inventions.

I wouldn’t have it draft claims for actual work yet due to confidentiality/disclosure concerns.

Absolutely not in terms of drafting apps. AI sources from things that already exist...if the invention is truly innovative, how will an AI write it? You need to give it at least a seed like claims you've drafted or maybe drawings/cad files, but even then it might not know what to call certain things that are new and be limited to what the physical relationship/positioning is and might not predict function. At best it could help but it won't be making very complete first drafts. You're always going to have to revise/draft some of it. The software ones that currently exist where you input claims are pretty bad.

Maybe at some point with taking a first stab at arguments/identifying the differences between the spec and prior art. For difference between claims and prior art you might have to input what the examiner's mapping/interpretation is. But in reality what I see is something that drafts boilerplate arguments based on a claim amendment with simple "x does not disclose or suggest [claim amendment language]" but you still might have to fill in some arguments if you want to do something extra (maybe impermissible hindsight.) And you'd have to review/revise to make sure the invention is not characterized other than with the claim language.

Where I think AI will have the greatest impact is upping what we'd expect from one of ordinary skill in the art if we assume someone of ordinary skill in the art is using AI tools

In prosecution, if a patent attorney does not try to remove prior art cited by an examiner (eg a 130 affidavit to assert an exception under102(b)(1)(A)), but instead makes arguments to overcome the art, may the attorney made an admission that bars removing the art later in prosecution. Taking the patent bar in a week and it’s been so tough studying while working. I’m so behind in my hours this month, and my firm (midlaw, IP only) was pretty clear that they expect my hours to stay on track this month regardless of the exam. How long does it take you to draft a patent application on average?

I’m a patent pros. paralegal working in bio/chem at my firm, 26 yo with an MS in Chem at 100k and a 115 hr billable req.
After the mental beat down that was grad school, I’m happy to have straightforward tasks and mentally coast, but my attys want me to start studying for the patent bar asap.
I like where I’m at and I know that once I start down the tech spec/agent/attorney path, it’s going to be full speed. How long do you think I can/should stay in this position before starting to study?

Where the best way to process POA for a large number of patent applications?

Is it to get a form 82 signed and attach it to different transmittals for each application and file separately in each case? Is there an easier way?

I am working on a NFOA for a design case. The Examiner identified a primary references and four secondary references. The Examiner also pointed out five differences between the primary reference and the claimed design. For the reply, I found nine additional differences between the claimed design and the primary reference, two of which are not present in any of the cited references. Should I clarify the level of a designer having ordinary skill in the art first? Complex/Expensive article. TY!
