I know several attorneys that do both at the same time.

If you want to jump from patents to trademarks full time, then I think you’d get a pay decrease. Trademark prosecution attorneys typically have much lower billing rates than patent prosecution attorneys.

Fully agree with P1. That said, trademarks can be a welcome breath of fresh air - in part because trademark examiners are all attorneys, so legal arguments tend to actually get considered properly.

If you want to do a full conversion over to trademarks, I'd recommend doing so gradually, but it's certainly possible.

Also agree with P1. Sure, it's possible. Obviously it's necessary to be intimately familiar with the TMEP and TM statutes and procedure. I prefer to do both Pat and TM pros.

I’m a designer in the planning/landscape architecture dept. of a CE firm. Extremely frustrated that after 4+ years and multiple asks, I’m not getting the in-field construction experience I’ve asked for. I know that my designs could be better if I could see how things are actually built but I get slapped in the face with “I need you in the office designing/drafting” or “there’s no budget to have you go out” and then sends an intern to inspect instead. Within my first year of Consulting, really struggling with the hours amongst other things. Spoken to a couple of people internally and the advice is to get on to projects with bigger budgets and therefore bigger teams/more support. For those of you who got out at 10, do you wish that you rode it out to 20? I’m at a crossroad and I’m not sure what to do. Have some active/reserve time, wrapping up graduate school, and am now considering either a) come back to the business world or b) go active and retire before 50 and live off a nice pension. Obviously there are draws to both. I’m an officer for what it’s worth so I can realistically retire at O-5, MAYBE O-6.

Applying to roles within the same federal agency. I know you need one year within the probationary period, but can I apply to a higher GS level? For example, if I'm GS 9, receive a promotion to GS 11 at the end of probation, would i be able to apply to GS 13 roles if I'm qualified? Almost 32 years old and feeling stuck. Been in advertising at creative agencies my entire career and wanting to make the pivot to client side marketing but am feeling very under skilled in certain aspects - project management, account management, digital marketing/CRM, data science. Outside counsel has been prepping company witnesses for a trial in August. It is my subject area so I am supervising outside counsel. I did not, however, choose the counsel. He is doing a really awful job. Co counsel is better, but not great either. Higher ups love the firm… I do not want to micromanage, but I have genuine concerns about outside counsel’s ability to try this case. I had one of those VERY nonproductive days today. I think I accomplished maybe an hour of billable work, even though I had a bunch of stuff to do. I just came off a 300 hour month, and unexpectedly got a continuance on a deadline on Wednesday, and it’s like all of my motivation leeched out of me at once.

In prosecution, if a patent attorney does not try to remove prior art cited by an examiner (eg a 130 affidavit to assert an exception under102(b)(1)(A)), but instead makes arguments to overcome the art, may the attorney made an admission that bars removing the art later in prosecution. Just received such a transfer case, looking for options.

I am working on a NFOA for a design case. The Examiner identified a primary references and four secondary references. The Examiner also pointed out five differences between the primary reference and the claimed design. For the reply, I found nine additional differences between the claimed design and the primary reference, two of which are not present in any of the cited references. Should I clarify the level of a designer having ordinary skill in the art first? Complex/Expensive article. TY!

Taking the patent bar in a week and it’s been so tough studying while working. I’m so behind in my hours this month, and my firm (midlaw, IP only) was pretty clear that they expect my hours to stay on track this month regardless of the exam. I don’t know how I’m going to get through this week and then make it through 6 hours of testing. Bit of a niche topic: I’ve been in TS/SCI processing for a Science/Tech/Weapons analyst position with the CIA for 3 yrs since I finished grad school in chemistry, but CIA positions are sort of set it and forget it since they can take so long. I’ve since been focused on a Patent Attorney track and am with a firm that will support me taking the patent bar/law school. If I get through processing and go to the CIA for some time, do you think would I be accepted back into patent law later on?
