Just curious: how much time would you bill for on prepping instructions to a FA for a response? Feel free to break down by how long you’ve been practicing, complexity, or any other factor you think is relevant.

It totally depends on the situation.

If I am rehashing arguments from another jurisdiction, it takes an hour or two.

If I am starting from scratch with new references, it might take 4-5 hours.

I’ve been practicing for about 10 years.

Paralegals usually handle this at my (large) firm.

I track my time, I’m just not in charge of sending instructions to the foreign associate. I draft and send a recommendation to the client, and if the client approves the recommendation, the paralegal relays the rec to the FA based on the wording of the recommendation I sent to the client.

Filing: $800-$1000. We have an extensive checklist policy we follow so it takes more time than you would typically expect. Normally these are PCT Nationalizations so it always involves the ISAWO and claim amendments.
OA Responses: $250-$1500. Huge range. Totally depends on familiarity and complexity. Some FAs do a nice job providing baseline arguments off the bat so those are faster and cheaper so long as we agree with the claim scope.

If you're being told "take your full lunch" (because by law you need to be given a certain amount of lunch depending on how many hours you work) but then you're told, if work's not done you need to stay until it is, and now people don't want to take their full lunches because it means they'll have to stay after work longer, is that coercion a violation of any federal labor laws?

I was recently (in April) fired from a good nursing position that I was at for 5 years. I reached out to my old ADON to get some information on where we had our vaccinations from and she told me that I should come back and the administrator that I had issues with is gone. Is this something I should even consider? I miss my patients and some of my coworkers and the pay is better, but I don't feel like I would really be welcome to come back.

Additional Posts in Patent Prosecution

Does anyone find an attack on the Examiner’s prima facia showing of obviousness a lot more effective than distinguishing each and every prior art reference.

I recently underwrote a reply to final. Didn’t even bother with the references since I just got the case. Overcame the rejections.

Can anyone comment on how effective this is?

In prosecution, if a patent attorney does not try to remove prior art cited by an examiner (eg a 130 affidavit to assert an exception under102(b)(1)(A)), but instead makes arguments to overcome the art, may the attorney made an admission that bars removing the art later in prosecution. Just received such a transfer case, looking for options.
