Send production an email so you have proof they ignored you.
Production 1: oh I told them, sent them links to the images. I copied 3 producers, spoke to them verbally about, and sent an email to the art buyer...no one did anything (yes I have all the emails saved)
I believe if you didn't change the vectors much Getty can find them. About 5 years ago they were sending letters to creatives that used tight comps on their portfolio sites and didn't buy the photos, and threatening big money, like 10k or something ridiculous like that. If I want to use unproduced work, I always put the comp in a reverse photo search and see if it comes up a Getty image, because if it does, their engines can find me. There was also a rumor that images had an embedded code and could "phone home." I'd inform production of all that and suggest they pay up.
Jail
Have a blast with the suey funsy times
Man vector graphics stolen from Getty is the sure sign of a Gold lion in the making
Well shit. Better buy them now. If they find out you used them without a license, a 5K license could end up being 50K.
OP - It does matter as Getty is known for going after live usage of products that were not paid for. In this case, they would go after the client as it’s their commercial that’s out there using its free vector.
Essentially it could come back to your company and become a bigger issue and could loose the client over a small dollar amount.
You should talk to your production dept and ask them to buy the right ASAP as well as talk to a rep and state the situation, they may ask for additional funds to be provided given that it hit live air without the appropriate rights/loyalties being bought, but at least you’ll cover your client and the company from any wrong doing/ legal recourse.
Rethinking. Send that email then rat them out to Getty. Illustrators should get paid for their work.
This happened on a project I was working on a few years ago. The image wasn’t royalty free and we had to pay a shit ton - they got to determine how many impressions it got and way overinflated it. Get something in email ASAP!
Yes. It is dumb. Because if you gave them a link to buy and nothing happened, there’s nothing to be done. Honest I’m not trying to be a dick, agencies are just assholes and don’t care. I agree with the paper trail though. I have had to battle a font issue, email your art producer so it doesn’t come back to you.
Well they all fucked up and you are covered for sure. Now it’s your choice to either ring the alarm or let sleeping dogs lie lol.
This is a dumb question
Is it AD2? Because some visuals are out in the world that I didn’t make? Is this an issue? Does it matter? Do people do it all the time?
By production do you mean your agency production department or client?
If it’s your agency dept, all they have to do is pay for the rights ASAP, and hopefully the final product didn’t go live yet before you buy the rights. If it didn’t you should be fine, no legal recourse can come about to the client.
If you’re talking about the client and they don’t want to pay for that specific vector, then you can’t use it on the final product. More than likely, they signed a production estimate agreeing to the production budget. Within that budget should have been an estimated amount for the vector and any other pieces you are using from Getty. Either way, as long as they signed an estimate, client would have to pay for that vector even if they don’t want to use it on the final product, it’s simply the cost of doing business.
Vector is probably royalty free so you can probably buy the rights right now.
If it's not royalty free, talk to the Getty rep.
It is Royalty free, I did tell them, they just didn’t buy it...
What’s ‘didn’t end up’? They forgot? didn’t bother? didn’t follow through at your request?
Thanks AMD...and no one went to jail? 🙄 ugh VP don’t scare a Youngblood like that...
You go directly to jail because they didn’t collect $200
