Preserves the error on appeal so the appellate court can make a determination of whether evidence the trial court excluded would’ve made a difference had it been allowed, in which case exclusion (if incorrectly done) was reversible error.

Jury leaves and you describe testimony, read a doc into the record, or put the witness on.

It’s a must to preserve the error.

There is an opportunity that I’m currently interviewing for that is very interesting to me. I’m interviewing two other places but I’m not responding to LinkedIn emails for other positions. The other positions don’t interest me as much. On one hand I don’t want to waste time prepping for all positions and rather put that time only for the ones that I have going on, on the other hand I feel like what is that falls through. I have been talking to a recruiter for a little over a month about a position. I am a 2nd year associate at a plaintiff’s firm specializing in toxic tort cases (individual). I’ve had the opportunity to be third chair on a trial, and will likely be second chair in an upcoming trial. FL peoples: I signed a lease for a new place to start May 1 as my current landlord sold the unit I'm in. Turns out, the buyer wants to keep renting the unit and asked if I want to stay. Of course I want to stay. My new lease hasn't started so I'm pretty sure I can easily back out. Is there such place as non toxic ID firm? Or does any of ID attys like what they do? I moved from general practice to an ID firm six months ago. Biggest mistake of my life. I am trying hard not to just quit and walk away as I’m battling head cold but still have to bill bill bill and get criticized for not billing right and etc and cases being piled up - while everyone is looking forward to the long weekend. I have a question for my fellow PI paralegals in Texas. TPCIGA requires that we submit all medical bills through the clients insurance before proceeding further. The client in question has Aetna. I sent the bills with a cover letter to Aetna via certified mail. I am having so much trouble getting a status on said claim. Does anyone here have experience with that and can assist me? Currently at a super conservative defense firm. I do really well but keep getting the criticism that I tend to just do things on my own initiative. I’m just predisposed to being decisive and rather autonomous. Besides being a solo atty, where would this skillset be better suited? Plaintiffs work?

Why do people “certify the question” during depos - this one guy says it after every instruction not to answer. From his tone it’s not to “mark” the section of the transcript for him later. Isn’t this an old school thing - like pre computers?

So here in CA there is a lot of talk about certain jurisdictions doing virtual jury trials. As a firm we won’t agree to it and if push comes to shove we’ll take it up on. Writ. What is everyone else’s opinion?

Trying to get ahead of my caseload feels like trying to climb a hill made of loosely-packed pebbles. No matter how much I scrabble, I’m sliding closer and closer to the bottom.

How do you get caught up (or even ahead) when you’re always behind? Assume that all things that can be offloaded have been offloaded. I cannot take one more all nighter trying to get a motion drafted two days before the deadline because I couldn’t get to it earlier.
