Juries are compromised of people not smart enough to get out of jury duty.
Judges (at the state level) decided it would be more fun to referee than play ball.
Either way it’s an unpredictable crap shoot.
In all honesty, I’d agree that most want to do the right thing. And when you’re talking about substantive criminal charges, or fraudulent abuses, civil rights disputes, sure there’s a civic mindedness aspect, you’re performing your duty as a citizen to contribute to the functioning of our legal system.
But most cases aren’t dealing with that kind of dispute. Why would the average Joe care about a $20M payment dispute between Turd Sandwiches Co A and Giant Douche Inc B? Or low level run of the mill crime with clearly guilty defendants (e.g. DUI’s, petty theft). Further why would they take unpaid time off work to deal with that?
Tbh, once I recognized that at some point one thing would go "wrong" or be unexpected, and I won some I should have lost and lost some I should have won, my anxiety dissipated.
Trials are failures of me effectively doing my job.
My first trial was by myself. I had observed a grand total of zero.
It was a blast actually. Got a substantial verdict with dubious evidence. Looking back now I laugh at how much I didn’t know. I guess ignorance is bliss.
It depends since it’s really about exposure again and again to trials or similar proceedings. A great place to develop approximated skills is through depositions, where you’re examining a witness just without a group of people watching. The more opportunity you have to expose yourself to actually examining witnesses in deposition, then in trial, the less anxiety you’ll have. Start with simple and straight forward exposures though — don’t try and surf a 50 foot wave right off the bat. Observing trials is okay but not as effective as doing witness examination yourself.
