What tasks do you have your IP paralegals doing for patent and trademark prosecution?

Patent: preparing shells and all filing documents, filing stuff, reporting stuff, dealing with the more admin tasks (changing staffing, opening new matters, docketing notes), etc.

What patent agent said - plus new app forms, preparing IDSes, clearing things with docketing, sending reminders emails to clients about instructions/upcoming due dates, confirming receipt of client instructions, saving all correspondence into the system, prepping and submitting assignment recordations, even taking a first stab at responses where it's just adding allowable subject matter or a restriction requirement. Shoot good ones can also take a stab at 112 corrections as part of the shell. **And ideally they are doing all this stuff on autopilot/when instructions come in rather than you having to ask each and every time.**

Basically anything that is not a substantive communication with the client, most examiner communications/interviews, and the substantive part of a draft app or office action response.

Some firms have a really great system down. The ones that don't can be hell to work at given the volume of cases prosecution entails. Even just having to ask every single time can take so much time away in your day that you probably aren't billing for.

My work gives us points/money for achieving certain activities such as exercising for 180 mins per week. I have my Apple Watch automatically sync with the app that tracks our activities and it works great. Problem is I started using NRC (Nike run Club) app for runs and it interferes with the Workout app on my Apple Watch and it doesn’t get tracked. Has anyone found a way for the NRC and Workout app to run simultaneously (pun intended)?

I have a coworker who keeps spouting comparative odds and situations in regards to the safety of the vaccine. Such as: you're twice as likely to get hit by lightening than have blod clots from JJ. It's very annoying and I find it to be really inapprorpriate, maybe because it's pushy or just I find these comparative things to be a bit irrelevant. How does one handle something like that? Can you shut the person down without starting a spat?

Hello Fishes,

Any idea when we get relieving letter/service certificate from TCS?

My LWD was 16th September and I received FNF 10 days before. Also got initial release letter on my LWD.

I see so many issues in this organisation.
When I joined TCS after 5 days of joining they used to mail me every week for 5 continuous weeks and asked me every time for previous organisation relieving letter.
But they themselves don’t share it and delay a lot.

Anyone please advise.

Any ideas for automating IP legal work?

Is it a viable business opportunity for a mid level patent litigation associate to leave BigLaw and consult? Service could include pre-litigation diligence (e.g., pre-litigation infringement analysis) for funding companies and law firms, overflow work, consulting for patent prosecution firms that take on ipr or litigation work, litigation consulting for tech companies that don’t have in-house counsel. Cross posting this in the BigLaw bowl.

Although I know you don’t need to pass the patent bar to “technically” do patent litigation, would it be a dead end move to pursue patent litigation without a technical degree / admission to the patent bar? In other words, would most BL firms refuse to staff associates on patent litigation cases if they don’t have a technical degree?

Do you think these names would be confusingly similar in same class of services?

MANUFACTURETALK vs MANUFACTURE HAWK

Not real names. Both start with same term - diff is between talk and hawk? I think it wouldn’t be confusingly similar as talk and hawk elicit diff meaning to a consumer. What you think?
