Hmmm. I send last-turn and cumulative redlines internally, but sending only a cumulative to outside counsel seems weird. Maybe not as weird if you're working from OC's original draft, but a last-version should go too.
Was their draft not ours, so seeing a redline against their form was pretty useless.
It’s a courtesy, so OC can see what changes were accepted and which changes were rejected. If you just do incremental, you will only show what changes were rejected or modified, not those which were accepted.
It’s helpful to know what was accepted specifically so you can assess the rejected items in light of the larger negotiation context.
Well yes, ideally you would send both.
Dealing with lender’s counsel?
I can’t say why but the only time it seems to occur is with lender’s counsel.
What sort of uncivilized people engage in such practices??
I send against last draft so they can see every change that occurred incrementally. I didn’t realize this wasn’t standard practice.
