Any advice on how to escape litigation? I primarily practice in federal court with section 1983 civil rights cases. While it’s been fascinating practicing con law, I realize it’s not very transferable and feel like I’m already pigeonholed in litigation. I do some advising for larger governmental agencies and enjoy working with their in house counsel. The only aspects of my current position I enjoy are the research, writing, and advising clients on their obligations.

Appellate work?

I’ve been having a hard time finding any open roles and the few postings I’ve come across require appellate experience. I’ve been trying to get some experience but haven’t had to appeal yet and the cases where OC has appealed have been dismissed for lack of jdx before briefing.

There are times where outside firms are retained but it’s not often because there are thousands of lawsuits so it’d probably bankrupt the state. Plus tax payers would likely riot if the state retained big firms, despite them being the ones who sue. DOJ is retained primarily to save tax payer $$$. Our billables are very low and the billables are more for accounting purposes so agencies can propose realistic budgets to the state.

In house employment counsel?

Keep going. You will get there. Tell them you really enjoy advising on employment issues as well as litigation management. That’s what I’m-house employment lawyers do.

When you say your salary jumped __x, how is that exactly calculated?

Mine was $16k (minimum wage before joining corporate) > $40k (contractor total before getting laid off) > $150k (current FT)?

Is that a 260% jump or 2.6x from $16k to $40k?
And a 375% jump or 3.75x from $40k to $150k?

Or do I calculate it by hourly rate?
