I am working on a NFOA for a design case. The Examiner identified a primary references and four secondary references. The Examiner also pointed out five differences between the primary reference and the claimed design. For the reply, I found nine additional differences between the claimed design and the primary reference, two of which are not present in any of the cited references. Wanted to understand if I can jump to company C if B hasn’t stilled filed from Perm? Also what happens if he files and not approved? Can I use my old i140 from company A to jump to company C?

Can you help explain why a team would be able to afford hiring an individual under PDM at a higher salary but unable to offer the same package under the Traditional route?

For context, I’m currently negotiating for a role and have expressed some of my concerns. My recruiter has been very helpful, but I’d like to better understand the reasoning before making my decision. The offer is $100k for PDM, but $85k max if brought on as Traditional.
