What kind of weed is the plaintiff and their lawyer smoking? 🤔
They want to be like big bad Chicago region lawyers but we ain’t in Chicago lol
I offered to hold mediation at a location closer to the plaintiff but plaintiffs counsel opted to have it 2 hours away from where the plaintiff lives.
We had a mobile claim rep there that familiarized himself with the case and had authority to negotiate and settle the case there, instead of having the main claim handler there travel from states away.
Plaintiff’s counsel has reiterated their policy limits demand and stated that we have 15 days to pay or they will not accept any settlement prior to trial and will seek excess verdict at trial.
And they said they are moving for sanctions because we “made” them do mediation and “made” their client show up and we had a mobile claim rep there who was not initially assigned the file.
Yeah, I can’t imagine a court looks at those facts and does anything but trash the motion for sanctions. Hell, it probably helps you if they file because it makes them seem like assholes
For those of you following on at home, sanctions have not be filed but they probably will be when I respond to their policy limits demand with authority of about $6k over plaintiff’s alleged specials.
Injuries and treatment aren’t really being disputed. The sticking point in this case is the time off work for the plaintiff. He was cleared to work and drive then quit a week before his return to work date. Then took two more months off before searching for and starting a job within 2-3 weeks. It is the carrier’s position that plaintiff is heavily overvaluing his pain and suffering, with no evidence other than his testimony to back it up the he needed those two extra months off before returning to work.
Update they just filed for sanctions today at 4:30 lol
