Not sure what experience level you are, but it may be helpful to do research that you’ll use for an sj motion later, see what you need to get out of the witness to help make your motion & make sure that at a minimum you’re including those questions
Sure you can, but I can tell you that if the witness is well prepared you can feel that way without having really committed any material errors.
You can. You can do it by being too prepared as well as by being unprepared.
For me personally, I have to have a vague outline of questions. Whether for deposition or for trial, I find that if I write questions and ask them verbatim, I am focusing on my next question and not listening to the answer given as much as the answer anticipated. I miss what I wasn't expecting. Therefore, I'm not able to respond with potential follow-up. By just having bullet point questions or just outlining the elements of a claim/offense/defense, etc. I am much more responsive to what the witnesses actually giving me.
