Very much weird. We can bill on our contingency cases
Second..very odd. We exclusively do Plaintiff's side work (and related to insurance but not PI) and always bill out.
I thought it sounded off... not sure there’s much I can do either way, but it’s good to know I wasn’t totally off-base to second guess it.
Yeah I do insurance coverage and we do some plaintiffs work for commercial lit/contract disputes. Always billing for it. A lot of the time our cases are more for the principle of something, not actually getting money
I’ve never heard of that, but that doesn’t meant it isn’t typical. You should be credited with every hour you bill, regardless of whether the partners manage to collect on that hour. That’s been my experience at 2 major law firms in a plaintiff’s side practice with lots of contingency work.
I'm in the same boat (I.D. that takes the occasional plaintiff case) but I don't have annual "billing" requirements because a large percentage of my I.D. files are flat fees. That being said, I always keep time in every case. Ethical obligations aside, we keep time as justification to request flat fee rate increases on the defense side. On the plaintiff side we keep time to determine the split on the contingency recovery.
