I’m in Los Angeles. I just started doing coverage work last year. Before this I had 6 years litigation experience in PI.
Pay ceiling & case load much better (at least if you are carrier side, no experience on policy holder side), half your stuff might be opinions or evaluations that can be one and dones, the rest litigation. Less depos and trial but heavy motion practice
Stupid question.. but as coverage counsel- who is your client ? The insurance company? The plaintiff ? How do you get the work?
My client is the insured. Hospital x gets sued for negligence or what have you. Hospital x has insurance policies in place that he expects to use to pay for defense in the litigation or cover any settlement or final award, but now insurance company is denying coverage claiming y, z. As coverage counsel, I represent the hospital in the dispute with the insurance company (not the underlying negligence claim although soooometimes my firm handles both). We also sometimes work with defense counsel in the underlying claim too to gauge the strength of the case and try to negotiate a settlement and get the insurance company to just pay that claim off if it makes sense, etc.
