A daily penalty if no certificate of occupancy issued and property not turned over to you by a specified date, if seller won’t agree a termination right with turnover of full deposit.

A right to have all punch list items repaired to your reasonable satisfaction prior to close of escrow.

From my title side, make sure you get an owners title policy that insures against mechanics liens. Your title company should collect unconditional lien waivers from all the contractors on the project, although some contractors are less than honest about their subs.
I'm a little intense when it comes to new construction and would do research on the contractor to see what their lien/court history is- if they have a record of nonpayment issues. I've seen new construction homes end up in forced foreclosure proceedings as a result of shady contractors.

Perhaps some type of warranty that allows them to fix certain things in the home, i.e. walls, foundation, etc. if it becomes a problem within the first 5 years of completion. Perhaps also seller's concessions.

I am from Oregon I have been at my place of work for 9.5 years. I am a CMA. With this company I have been a Lead MA, Scheduler, Float Lead, surgery assistant. Do you review the other side’s escrow instructions and provide comments? 4 years in and I’ve never done this. Working for a new partner and she insists on doing so “in case there are competing instructions” but isn’t that the entire point of funding through an escrow agent/title company?

Any advice on shifting from association law to commercial real estate in FL?

Pro se plaintiff, an attorney, filed a complaint alleging mold defects after closing on a property. Client, layperson, may have agreed orally to a settlement amount without proof of damages prior to filing appearance and obtaining an attorney. Client filed appearance pro se, then plaintiff sent over a draft settlement agreement few weeks later which client didn’t sign.
