Can I withdrawl from a case where I advised the client to take the plea and he will not. Can I withdrawl before trial for going against advice?

Do a CYA letter for your file documenting the offer, why you recommended they accept and why they declined. Get them to sign a clause, if you can, that acknowledges they are acting against attorney advice. Then do the trial since your motion to withdrawal will likely be denied. Good luck.

Why would you do that? They’re your client, you’ve lost some control but ultimately agreed to rep them. Take the case, do your best, you’ve advised client of the risks.

If you’re worried about nonpayment, then you fire for nonpayment, yes?

I focus on law firm risk management and from my perspective, if you’re considering withdrawal it’s probably already too late to be withdrawing. Problem clients, in my experience, only get worse. Eject!

Jurisdiction and fact dependent but probably “yes,” will the court actually grant your motion… probably “no” would be my guess. Good luck!

For criminal? State level I assume? Are you privately retained or court-appointed? Not so easily really, anyway. Look up your local and ethical rules first the limited situations.

How normal is it to be pulled off a trial team because you tell your boss you are moving after trial? I have a trial coming up first week of Oct. This case has been my baby, and I’m going to try it with my boss. I tell my boss up front that, for family reasons, I’ve gotten a new job and will be moving to another city two weeks after trial will likely end. He then gives my trial witnesses to another attorney, but is still going to make me do grunt work. Is he unreasonable or am I?

I'm entering my final year of law school but am going part time since I work full time as a paralegal. I have been a paralegal for more 10+ years and I want to open my own firm after I pass the bar.

I've worked at a lot of different size firms including a startup with a few attorneys and I was able to help with a lot of the ground work with getting the practice management system in place and still do some of that now at my current firm.
