When potential clients tell you they’ll hire your firm but they want to be 100% reimbursed from you if you aren’t able to get them the outcome they want - how hard is it not to laugh?! 🤦🏽‍♀️🙄

“Ethically I am unable to guarantee any specific outcome or result” is my go-to. But, if you have any discretion on whether to take that case or not…run (as it seems you are already most likely aware). The day when I take cases like that has already passed.

Oh yes, I informed them that no attorney would be able to guarantee results as it would violate our ethics rules and that it’s best they look else where for representation. Definitely lucky enough to be able to pick our clients as opposed to taking anything that comes in the door, unlike the first couple of years of starting our practice!

I recently gave my small firm notice that I am leaving and moving to another state. I mentioned that I am considering starting my own practice in the new area, and the managing partner suggested that I transition to an “of counsel” position at a 1099 hourly rate (remote) while I got started.
