Per AICP Guidelines, If notice of cancellation is given one to ten working days prior to the shoot, the client is liable for all out of pocket costs, full director’s fee as bid, and full production fee on the job as bid.
sorry but you can pre-negotiate kill fees. AICP Guidelines are exactly that.
We had this happen last month. Shoot canceled 48 hours before the shoot on the location scout. We paid our director 100% of their rate.
She should receive her full directors fee plus reimbursement for any hard costs, like taxi to the airport, etc. No one can prenegotiate kill feed, so she is at the mercy of the production company. Hope they can get her what she deserves….
I think you are missing the point of OP. Regardless of what production company charges (AICP or not) there are some shifty production companies out there and the prod company would be responsible for paying the director. Being freelance I’m sure there is some anxiety that the production company won’t pay her so hopefully she can prove she was booked on gig and at least get the shoot days out of prod company.
AICP guidelines have the prod co receiving the directors fee as bid in full if the job is canceled 10 work days or less out. A minimum of 50% of the directors fee if it’s more. Many clients that specifically don’t follow AICP guidelines list their own kill fees in the contract.
If they were scouting, sounds like they are within 10 days. Even if AICP guidelines aren’t being followed, the time can’t be rebooked at that point.
Yeah…and most clients do not agree to abide by them. But they are a great guide.
This! If it is an agency and or a production company worth anything they will make sure director gets paid! And if they don’t please share who so that the rest of us don’t engage them for a project.
They need to bill the prod co for the full amount asap. If they don’t pay then reach out to the agency.
