Florida attorneys: You guys feel tort reform? Because I been on the market trying to get a PI gig as a 6th year, and it seems almost nonexistent. I spoke to a recruiter and she said its been hard to fill both defense and plaintiff PI positions. places want newer attorneys.

Forget about trying to business as a little guy too! No chiros etc. Are giving out work unless you been with them for some time.

Maybe its time to explore a new area. Would love to know if you guys noticed it.

What are good KPIs for personal injury support staff?

New to PI. I filed suit and know policy limits ($500k). I want $1M but I have to live in reality. Insurance company wants to know if I have a demand. Is there any reason why I’d demand more than the policy limits?

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

Has anyone ever dealt with Geico UM case where they insist that a release needs to be signed? Geico extended our client’s policy limits but wants him to sign a release. We offered to sign an acknowledgment of receipt of funds but Geico said without a release signed, they will not issue payment.

Strictly defense work; started out with the City Law Dept, did a year and a half of med mal/construction, and for past year and a half have been at a well known defense firm working on high exposure construction accident cases. I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

As a former Corporate Counsel, now mostly solo practitioner in Federal Court specialty practice is a mixture of Bankruptcy, Immigration, Business Transactions and Employment law.

What’s a good LA or NY business litigation firm and salary to expect? I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. Write every kind of brief, appeals, argue motions, take depos. Am the only associate working directly under partner on all cases. In house or M&A/Real Estate Transactional are likely the end goal but want to get the litigation out of me first.

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.
