Florida attorneys: You guys feel tort reform? Because I been on the market trying to get a PI gig as a 6th year, and it seems almost nonexistent. I spoke to a recruiter and she said its been hard to fill both defense and plaintiff PI positions. places want newer attorneys.

Forget about trying to business as a little guy too! No chiros etc. Are giving out work unless you been with them for some time.

Maybe its time to explore a new area. Would love to know if you guys noticed it.

I’ve seen job posts for ID firms but not many plaintiff firms

like

Yeah same .... a lot more ID firms.....Looks like ID firms cannot hire anyone (generally) and plaintiff firms over employed last year and everyones staying put and probably getting let go in the next couple years when those cases are gone

I got out of first party thinking PI wouldnt budge but its looked like it has

What part of florida and what kind of litigation experience do you have?

Oh, south florida.....ft lauderdale to west palm area.

On the defense side, it is extremely busy rn bc all the cases filed before the reform deadline are getting to trial periods, but new lawsuits served are definitely lessening, so I can see it drying up for plaintiff’s side right now in terms of new hires or new work

Yup.

Yeah man, the cases are not paying out as they used to. The boardable/billed amount paradigm has slashed much of the value you can get from a case. Now, it seems that most of the value you can extract for your client in an average matter would largely be coming from your provider negotiations.

Hi All,

I recently obtained my law degree and currently work for a BigLaw law firm as an assistant. How do I approach my HR department as well as the litigation bosses about transitioning to litigation? Any ideas would be helpful.

Thanks

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

I'm a 6th year attorney in NYC. Strictly defense work; started out with the City Law Dept, did a year and a half of med mal/construction, and for past year and a half have been at a well known defense firm working on high exposure construction accident cases. Contemplating taking a couple interviews at plaintiff's firms to see if there is a good fit. Hello All,
I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay.
