As someone that’s now on the in house side and worked at a firm for many years I understand that often those in house know the answer (or have a general idea) but need it in writing from outside counsel for CYA or so our internal clients actually listen/realize we know what we’re doing.
No. Sometimes questions are basic, but the whole point of clients paying a lot of money for legal representation is the ability to ask any question and receive timely and precise advice.
No, if anything I assume you have a lot on your plate and need a quick gut check or CYA. Plus I love getting a softball now and then. It makes up for the times I feel like I’m a dummy.
No it makes me feel like a genius
Ngl, I'm just thinking about how much I'm billing to educate them.
Depends. If it’s someone that *should* know better because they either have come from experience where they should know or because I have told them 5 times already, yes 😂
Absolutely not. I really appreciate in-house counsel and the perspective they bring on the business side of things (which often we, as outside counsel, are not privy to).
I have. Specifically as an estate planning and probate attorney and bank attorneys.
No. When I was in big law I knew my role. We all specialize in something. But as a restructuring lawyer when I was in big law I knew it’s an area of law that most in house lawyers aren’t familiar with. (They usually didn’t want to be, for obvious reasons, unless it was part of a takeover by their company.)
Having been on both sides normally no. I do not like though when I have to educate a senior associate in big law
I’m in tax. Nextera has significant tax issues because of ITC/PTC. Sometimes I’m helping outside counsel get up to speed on issues that are clear for us internally.
Rising Star
Not always, but sometimes, absolutely. And I wonder why/how they have that gig and I don’t (but only when I know it pays $$$$).
