Always tell the truth.
This happened to me years ago and it cost me my TS. I also had it expunged.
The process now is if you disclose it even if it has been disclosed and you don’t have any other 🚩, you should be okay
Good luck
Just fyi, expungement is a court process only and doesn’t get rid of the record of the arrest. Depending on the state an expungement May only have a plea set aside and dismissed, which it doesn’t seem like you went through. Anything further than that would require following whatever process your state has for sealing arrest records. For instance California has penal code 851.8 and 851.91(and others) which provide ways to have the records of your arrest sealed…making it as though the arrest never happened. Even in those…851.91 for instance…law enforcement can still see that the arrest occurred. Also the entire process can take years…the court may grant the motion within a few weeks or months of filing, but LE agencies are so backed up in paperwork that it may take a couple years for the request to be processed. Keep in mind also that there’s multiple entities that have records…the court order usually has to go through local, county, state, and federal agencies.
The federal background investigation will reveal pretty much every legal thing you have been involved with. It doesn't matter if was sealed or expunged. National security concerns trump those things.
Everyone above is correct. Tell the truth. I have a TS/SCI with FSP. I’ve had issues in the past that were expunged. Just explain the situation and you’ll be fine. Plus they aren’t looking for that stuff. They want to know if you can be blackmailed and will sell secrets.
