How do I deal with the constant fear of getting disbarred?

I am in my third year and some perosnalities of the different clients I have give me the worst anxitey. They are always charged up ready to blame when something doesn’t go their way.

I serve as outside General Counsel to solo and small firms - you’ve got to really have it coming to get disbarred. DM if you ever want to chat about some simple steps you can take and keep in mind that attorney mental health is involved in 55% of all legal mal and ethics claims, so take care of your self!

You have no idea how badly you need to screw up to get disbarred. I know lawyers who have criminal convictions, 3+ duis, domestic issues, and so on, and are still licensed. You literally have to steal or do something seriously illegal like commit insurance fraud get dinged like that. If that’s what you’re doing, then you deserve to get disbarred. If your firm is doing something like that, then speak up or leave, because you don’t want to ruin your professional reputation getting caught up in that. Otherwise, you should be fine. Stay on top of your files, be ethical, don’t lie to try to get your way, and you’ll sleep well at night.

48 hour turnaround time isn’t terrible IMO, but not great either. Personally I aim for a same-day response (unless an email or call comes in outside of business hours), even if it’s just acknowledging the message and promising a substantive response by a later date.

Attorney 4 is right: the client gets frustrated and/or concerned when they don’t hear back. Now, to be fair, occasionally you get a client with unreasonable expectations about response times, and a conversation is needed to manage those expectations.

Don't get in over your head, don't drink to excess or do drugs, take care of your mental health, don't let any clients/cases fall between the cracks, be responsive, have adequate support staff, and don't steal trust funds, even for 15 minutes.

I’ve dealt with a LOT of lawyers. Trust me when I say it’s a really high bar to get disbarred.

My neighbor was disbarred twice if that helps you. First for commingling clients funds, and he was professionally sanctioned three times prior for this issue. So he had warnings. And it was not like a simple miscommunication, he was stealing clients money fairly obviously. The second time was for practicing without a license. The first one was a disbarment for a set number of years, the second was a permanent one. Guy has talent, but not in a good way.

Like, talent for getting disbarred? Lol

Has anyone received equity as contingency comp? I have a potential client with a founders dispute. He doesn’t have cash, and the other founder ripped him off and is now running the company. 3 attorney firm. I’ve been here for 6 years and have used Westlaw exclusively. Now we are switching to Lexis because apparently Westlaw is too expensive. I hate change. I work at a small, 3 lawyer firm. One of the lawyers is not barred in the state we practice. Because of this, the managing attorney has been having him draft motions and other legal documents and use my name and bar number and having me file them because I will have to appear in court for the matter. Is this normal? I am not provided time to review the materials before I file them so I end up working longer days because I am nervous to file something using my name and bar number.

I'm entering my final year of law school but am going part time since I work full time as a paralegal. I have been a paralegal for more 10+ years and I want to open my own firm after I pass the bar.

I've worked at a lot of different size firms including a startup with a few attorneys and I was able to help with a lot of the ground work with getting the practice management system in place and still do some of that now at my current firm.
