it is strictly illegal in the US for an employer to withhold wages you have already earned. Legally, your employer must pay you for all hours worked, and withholding final pay entirely is a clear violation of the Fair Labor Standards Act (FLSA).
While federal law only requires final pay to be provided on the next regularly scheduled payday, state laws set exact deadlines. Many states require much faster payment depending on how your employment ended:
If you are fired/laid off: Many states (such as California and Illinois) require your final paycheck to be provided immediately or within 24-72 hours.
If you resign: States often require your pay by your last day or the next regular payday.
If your employer refuses to pay or misses your state's final paycheck deadline:
File a Federal Wage Claim: Report the violation to the U.S. Department of Labor to recover your unpaid wages.
File a State Wage Claim: Because labor laws vary, visit your specific state's Department of Labor to file a local wage complaint, which may include penalty fees paid directly to you.
Yes and in CA interest is added to your paycheck. My son ended up getting $2,000 for a $200 final paycheck.
You're other option is to file a complaint with the Department of Labor, good luck given the current administration
Legally they have to pay you or I would get an attorney or legal advice. You can go to Rocket Lawyer and you can speak to legal advice through that app it's a pretty awesome app. Shoot you might end up with more than what your paycheck was lol and they should know this if they own a business
Depending on how long you have been waiting and how you have been approaching the situation like how you’ve been bringing it up and asking about it you can go straight to suing if you believe your case is strong enough and that you know you’re 100% in the right
Contact the labor board for your state or an attorney that specializes in employment law or both. They have to pay you regardless of why you were let go.
Doesn't really matter if the company policy is to withhold pay, if they advertise the practice by putting it in a publication they are just asking to lose a lawsuit. State & federal law trump company policy every single time.
My mom worked for them and they terminated her too. Pay was an issue so she sued them and won! Don’t let them get away with that.
I highly doubt they refuse to pay your last. DHL is too large of a company to not have a legal department. What's more likely is they are gathering your last week + any unused PTO/SICK and comparing it against any potential PTO/SICK advancement or potential damages you may be liable for that caused your termination. Then they will pay out accordingly.
Contact the department of labor. File for unemployment and watch how quickly they change their conversation!
they have to pay you for any days that you worked that last week what is their reason for not paying you??
Contact your state’s Department of Labor and Industry, or whatever the exact name for that function is in your state.
I would seek a labor law attorney . Once they see you seeked an attorney they WILL PAY AND SOME .it is illegal whether you area citizen nor not .
I concur. Call your state DOL
It’s illegal not to pay you for hours worked. Go to union rep if you have one AND the Labor Board.
EEOC contact them
So what is their reasoning for not paying you for your last week of work? Do you still have company property? One place I worked seasonally, after they told me it was my last day, I told them I’d wash and return the uniforms the following week, and I did, and like an hour later I got my last check direct deposited into my account.
Employment lawyer could be a form of retaliation or unlawful treatment.
How long did you work there? Did you have a sign-on bonus? Were your benefits paid by the employer?
EEOC
It is illegal, well it used to be illegal, to not pay for time worked. The only caveat would be if they are claiming theft of time. That would need to be in writing as to the reason. I think they're a German company so laws between borders may govern. The current administration only cares about paying into their personal pockets, so private atty may be only route. Try your states atty or atty general. Good luck; GET YOUR MONEY.☮️💙
call a employment lawyer. not only are they withholding you but also the taxes they have to pay the gov't. do this before the labor board
If you're in Texas, it's the Wage and Hour bureau that regulates this.
