I work in an at will state but signed and employee contract agreeing to hold my employer harmless. I am planning on leaving my PI job for personal reasons and will not take any clients to the new non-pi job. I plan to give full notice and do all I can to transition all files. Have you ever seen/ heard of an employer suing an employee for leaving if, say, the client wants to go to another firm? My boss can be vindictive and I am worried

Yes. However, this never works out in the law firm’s favor if a client reduces their desire to leave in writing. The client determines who they want their lawyer to be when you leave. The rules are very clear on this. Notice is typically provided to all of your clients advising them of their ability to stay with the firm, leave with you, or retain a new lawyer.

Yup!!! One memorable lawsuit.
Lawyer went on 3 months maternity leave from ABC law firm (exclusively practicing family law). After two months, XYZ law firm reached out and said ‘come work for us for more money, more flexibility, and fewer hours.’ Lawyer told her employer about the offer, that she was taking it, and offered to work for two months before leaving. ABC law firm told her she had to repay three months salary and she was unwelcome back at the firm due to having accepted outside employment in breach of her contract. ABC law firm then sued her for the money.
After the motion for summary judgement was filed by the terminated lawyer, ABC Lawfirm conceded the motion and the matter was dismissed.
Epilogue: owner of ABC lawfirm ran for judge … and lost. Badly.

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. I give my cell phone to all clients routinely. However, there are always 1 to 2 clients who abuse this and it seems as soon as their cases are over I find a new one and it is making me rethink. I hate to do this because 98% do not abuse it and I like being connected to my people. Thoughts??

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??
