If someone, who works for a plant company (sells to walmart) and that someone, while checking on one of plant company's walmart stores, tripped over a broken traffic sign covering a 6 inch bump in the parking lot. is someone required to go through workers' comp? Or can he directly go after walmart/company in control of maintaining parking lot?

You’d need to specify which state this occurred in.

like

Happened in nj but i cant imagine all states being completely different.

My google searches can only take me so far, so maybe someone has dealt with the issue is any state and knows a little to either flat out answer the question or their info from a different state can give me a more precise research inquiry.

I would say if it happened while performing your job you can submit a claim for workers comp. You can also have another claim against Walmart, which your workers comp settlement will likely be brought in that you have received payment. If you get a bigger payout from Walmart, the settlement will need to pay the workers comp lien.

A1 said it best. That’s exactly correct.

I'm a 6th year attorney in NYC. Strictly defense work; started out with the City Law Dept, did a year and a half of med mal/construction, and for past year and a half have been at a well known defense firm working on high exposure construction accident cases. Hi everyone - I'm contemplating an offer from a large PI firm. I'm a little more than halfway through completing my 2nd year of practice, and I'm currently at a small firm with a low salary that's just no longer cutting it.

The offer from the large firm is for a pre-suit position, base salary of $100K - is this salary pretty standard for this kind of position?

Any insight is appreciated, thank you!!

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??
