Is it just me or does it feel like I am the only person who thinks 10 steps ahead or uses any common sense anymore? Are people getting dumber or lazier? Or do they just not care about their work product? Or are they overwhelmed? I’m overwhelmed! Should I stop caring as much?

It definitely isn't you. Especially since COVID. There are a lot of firms out there who hire the cheapest person they can find, whether or not they can grasp the work or even have the desire to do law. All to cut costs and keep payroll down instead of paying experienced people or giving current employees reasonable wages. Then wonder why high employee turnover and poor client service. I am leaving my firm after 10+ years because they don't want to do things right, just fast and provide the bare minimum to avoid malpractice. It's ridiculous

serious response, this field is not filled with geniuses like some make it out to seem. paralegals file their work, attorneys don’t proofread, many people are overwhelmed, many just don’t care enough. there’s a lot of low-quality work in law that people don’t often realize. not just you, by any means.

PI is also the lazy man's ticket to earning a decent living. They never really hit the good numbers but they can always find some firm to hide in and still be comfortable. I've got attorneys that get the basics all fornicated up and then blame their paralegals. When I try to replace them it's an absolute disaster. I want to interview 1-2% of the candidates we get sending resumes in.

You blame others but are you not the leader to show them the way? Blaming paralegals is not the answer since they do not have the medical training or understanding. Legal Nurse Consultants bring medical knowledge and an understanding of healthcare. Even lawyers do better with an understanding

For those working in house, how much “from scratch” document drafting are you doing vs. reviewing and revising “outside documents”. For example, if your company wants to enter into a joint venture company with another entity, are you drafting the company agreement “from scratch” or is it based on internal forms? Or are you getting outside counsel to do it?

I have billed 4+ hours today helping a partner prepare a 10 slide PowerPoint for a board meeting tomorrow. Let’s say half of the time was fixing spacing and formatting. I really don’t care as I am billing all of it, but am I wrong in thinking this is unjustifiably too common and a waste of time?

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

(3rd year. Salary=80k and no performance incentive. I brought in $1.4mm AFTER partners claimed over half of fees on my big cases.)
I see CJL offers an incentive+ base but I’m curious about that structure.

Is it impossible to actually earn a respectable incentive bonus?
Am I going to have some partner come cut me out of any cases where I might actually make a solid fee?

Has anyone ever dealt with Geico UM case where they insist that a release needs to be signed? Geico extended our client’s policy limits but wants him to sign a release. We offered to sign an acknowledgment of receipt of funds but Geico said without a release signed, they will not issue payment.

I give my cell phone to all clients routinely. However, there are always 1 to 2 clients who abuse this and it seems as soon as their cases are over I find a new one and it is making me rethink. I hate to do this because 98% do not abuse it and I like being connected to my people. Thoughts??

Hello All,
I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

New to PI. I filed suit and know policy limits ($500k). I want $1M but I have to live in reality. Insurance company wants to know if I have a demand. Is there any reason why I’d demand more than the policy limits?

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

What’s a good LA or NY business litigation firm and salary to expect? I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. Write every kind of brief, appeals, argue motions, take depos. Am the only associate working directly under partner on all cases. In house or M&A/Real Estate Transactional are likely the end goal but want to get the litigation out of me first.
