Just started a new job it in civil litigation, mostly insurance defense work. Came from criminal work the past few years. Having a hard time understanding billing, ie what the client will pay for, how to phrase it, and how to be efficient with what im doing. Im a little nervous about meeting my target at the end of the year. Does this get better with experience? Any tips?

It gets better with experience. I assume you're not on your own completely and have a partner you're reporting to. Bill literally everything you do and let them cut it. They may have a list of phrases or your bill. Will you people might that will get past insurance Bill reviews and not get cut. If not, try and keep it as basic as possible and you'll learn as you go.

For your phrasing, just put what you’re doing and why you’re doing it. IE analysis of summons and complaint in order to prepare answer to same. And ask your partner whatever questions you need to on a carrier by carrier basis (or look at the carrier guidelines) so see what you need authority for. Some carriers let you just review medical records because you’re obviously not doing your job if you’re not reviewing meds on personal injury cases, some carriers lack that common sense and make you get authority in order to review them. Billing for that would look like “reviewed X pages of medical records from X facility in order to X (develop medical chronology, develop damages and liability analysis, etc.), by authority of X granted via email on insert date here”. I also came from criminal law and had to adjust. It’s going to take some time to get out of the crim mindset because it’s so different. But you’ll get there

It may seem obvious, but in my experience partners value trial experience over anything else, so get it however you can. For example, my firm will favor a former prosecutor who has seen the courtroom a lot but has no civil litigation experience (not even a depo) over a seasoned associate who has only second chaired cases with a partner but hasn’t tried a case. Even trying a case and losing gives you credibility at my firm because you still did it.

So here in CA there is a lot of talk about certain jurisdictions doing virtual jury trials. As a firm we won’t agree to it and if push comes to shove we’ll take it up on. Writ. What is everyone else’s opinion?

I’ve been working at a rather prestigious midsized firm in a big city for almost a year and a half now. I have been having a lot of trouble picking up work from senior partners. We are required to bill at least 150 hours per month to meet our requirement. My months are typically only 110-130 hours. Does anyone work at a firm where legal assistants don't do legal assistant things? For example, I have to do my scheduling and calendaring. I have to upload documents to our file management system. This morning, a name partners assistant didn't realize the name partner had a depo and didn't confirm it. This is how this firm as been for decades and it's incredibly frustrating to work this way. It's so hard to not stress over this daily.
