Me and my husband are going through a divorce. We own a 3-unit apartment. He got a new tenant in October. This tenant was having issues paying rent since they moved in. But in December they applied for rental assistance program and got approved. My ex didn’t tell me but he was paid rent in advance through May 2025. I only just found out yesterday. This whole time he was telling me and the divorce lawyers that we have a squatter. I talked to the tenant and she told me all this. (1 of 2)

I’m not following. When the rent is paid he uses that revenue to pay expenses. Vacancy, capital expenses, insurance, principal, taxes, any landlord utilities. The assets are 50/50. So he buys you out or you sell the apartment, collect your half. If it were a partnership, it’s typical to get yearly distribution based on profits. A monthly distribution wouldn’t account for the year of expenses and might leave you short if a major repair is needed. The profit should show up on his tax return next year, you could probably estimate based on 2024. Also tenant may not admit to being a squatter. Have you ever known a flaky person to take accountability? The lawyers job is to ensure you stay angry until they get their cut. A happy divorce isn’t profitable. I don’t think any of this requires you to knock on a tenants door.

Gotcha, yeah this can’t be hidden. Rent is either hitting the business bank account or it isn’t. And yes the new buyer will request income/expenses and it shouldn’t be a secret to a buyer or you. If the property starts showing anything delinquent, buyers will smell distressed sale and offer less.

(Cont..). Unfortunately, tenant can’t get receipts. And tried calling the rental assistance company but they’re not picking up if returning her calls. It’s time sensitive and I need proof to present to my lawyer.
He signed the rental assistance forms and didn’t tell me. We both own the building. I’m wondering if they’ll give me any information if I call them and ask? I just feel lost….

Get a sworn affidavit if you need it for your divorce proceedings. Id also bring any documents relating to it including what he signed. This is better than nothing imo

Did the tenant pay cash? Can they not provide a bank statement that shows a transaction to your husband (even a cash withdrawal for an amount a that would make sense in this situation?

Have your lawyer file a subpoena on your husband to compel his financial documents.

There has to be a document trial that shouldn’t be moving mountains for you to get a hold of. I’d push hard on her to figure out how to get a receipt or in your eyes she hasn’t paid and should start the eviction process.

Thank you, that’s what I’m thinking. Just surprised my attorney didn’t think of this and we’ve been chasing for the past 4 months now.

I have 1 job offer that is an hour away and pays 45k, after negotiations (Research Associate Position at a University) .

I have just interviewed for a position closer to home and a base salary of 65k, but haven’t heard back from them in about 2 days (He said he would make a decision by yesterday and I’ve reached out).
I have to decide on the first offer by Thursday but I haven’t heard back from the second yet. Thoughts on next move?

I'm under contract for a new build in progress that won't be done until much later this year. I fully expect interest rates will be higher than what I originally estimated. I may or may not try to lock in a good rate early, but I'm planning on renting it out and this throws a bit if a wrench in my margins. I can take it financially, but wondering, If I absolutely needed to get out of buying it, what recourse do I have? Or could I go ahead, and refinance later (who knows rates at that time...)?

Question for folks with second homes: Considering buying a vacation home but would be primarily for family use. We currently have a primary residence with a mortgage balance of ~640K, so my understanding is I could only deduct the mortgage interest on 110K of the second mortgage to stay under the 750K cap. If I were to buy the second home through an LLC, would that allow me to exceed that 750K since the expenses of the second home would be pass through expenses/income?

2. Put the land under said condos into a land conservatorship (for taxes)
3. Rent condos at discounted rates (for taxes)
4. A small fee of the rent goes to a trust as a land conservation fee in perpetuity (for tax reasons)

From a financial standpoint in this market, which would be a better approach in Austin -

1. Buy a ~8-850k house that meets most of our ideal criteria (size, schools, interiors etc) to stay long term

2. Buy a ~5-550k house that’s not ideal with the plan of moving into an ideal home in 4-5 years when kid is ready for school.

Better mortgage vs. Rocket mortgage - anyone shopped with both and what swing your decision?

Due to a family situation we are looking to move to a different state. Normally we would sell our current home and buy a new home in our new location. However, with todays prices and interest, will it make more sense to rent out our current home and rent a home ourselves vs. selling and buying immediately when we move? We are moving from Vegas to Sacramento and we are not sure how long we would stay in the new area. Thoughts?

We just moved into a 50 year old house. We got the popcorn ceiling removed in the garage plus had the walls done. We didn’t use an official asbestos expert because of the price.

The horrible, dirty people that lived there before us left us a crappy mess. Hope we are not exposed, nor the neighbors.
