My Managing Partner asked me to massage some billable entries and my stomach is in knots. He told me to take the 0.4s and turn them into 0.8s because the client won't notice and we need to hit our quarterly goals. I’m a junior associate and I’m terrified that if I say no, I’m fired, but if I say yes, I’m risking my license before I even have a career. Do I report this to the ethics board now?

You should obviously refuse to be involved with that, and you should report it someone in authority. It might also be a good idea to first document exactly what you're being asked to do, as there's a good chance your colleague may deny it. If things like that happen at the firm you need to find a new place to work. You don't want to be casually committing fraud, and there's plenty of legitimate work elsewhere.

Did he actually say that—or did he just suggest you haven’t billed enough for the project ?

like

I wouldn't change it and I'd talk to the GC

like

You’re not risking your license and certainly don’t report it. I was in a similar situation and told the MP that it did not align with my values and they could change my entries on the backend if they feel that I am under billing (note: they can’t).

Can you find the additional time worth of work to do on the matter? That would seem like the easiest solution.

like

Don’t do this. Tell them you are not comfortable and look for another job.

like

I would recommend doing what you have to do to keep the job and start looking for another job. If you were going to report it I would wait until you are gone. Not to hijack, but I have a billing story which makes this look like small potatoes. How about attorneys billing 300-plus hours every month for starters? Yes, it's true.

like

Are they actually working that much?

Oh boy be very careful.

like

Isn’t this common practice? There are nonbillable tasks attorneys do daily and just wrap that time into a billable task. For instance, budgeting. Typically not something a client would pay for so you pad the time spent on a billable task…?

I recently had a specialist partner send me a fairly nasty email after I (a transactional first year) was told to ask them to review something ASAP that had clearly been on my partner’s radar for over a week. Why am I taking the (honestly justified) blame for this? Surely it should be obvious that I’m just the messenger here.
