Is it a viable business opportunity for a mid level patent litigation associate to leave BigLaw and consult? Service could include pre-litigation diligence (e.g., pre-litigation infringement analysis) for funding companies and law firms, overflow work, consulting for patent prosecution firms that take on ipr or litigation work, litigation consulting for tech companies that don’t have in-house counsel. So, some of my co-workers simply said that they want to go ahead and start something or start looking elsewhere (career change) because they don't know how much it will last at the pace we are going in regards to case intake and pay out. I have a tax LLM and started my career out of law school doing M&A tax at a big4. After 9 months, I got out of big4 transactional hell and into whatever litigation I could find. I now practice commercial lit but would welcome the opportunity to eventually transition into tax controversy (which I wasn’t able to do before). Does my commercial litigation “break” hurt my prospect? How long can I stay in com lit without hurting my chances even more?

Hi all! I’m applying to NYU tax llm and I’m pretty confident I can get in,but it’s unlikely I’ll receive a scholarship. I’m working at a non big4 consulting firm for about 1.5yrs now, doing mainly international with some M&A exposure. I want to do llm because I still want to shoot for biglaw. I have a small kid so it’ll be hard to do the program part time. Should I quit my current job and enroll full time? Meaning lose 1yr salary and taking on a job security risk. TIA!

I’m a new associate to a T&E group, partner goes away on vacation and leaves me with a 706 to review and sign. The family is very wealthy. Decedent married for 60 years. Partner says it’s “just a DSUE election, decedent was ill for years, no assets.” Provides no records. Not even an admission the decedent owned a toothbrush. So I looked up the decedent’s home - it’s a joint asset. Partner was “surprised”, and still insists “no other assets”. I found file references to art and antiques.

Has anyone dealt with stuffing allocation in a non-hedge fund context? It seems even in the HF world the law is fuzzy in using aggregate reverse 704c principles in stuffing allocations. Like, sure, the market is there but no authority really blessed it (other than some Cravath partner’s article in Tax Notes in 2013). If we are talking asset class that isn’t really like marketable securities but might be able to treat it similarly solely by virtue of, say, valuation on a quarterly basis (contd)
