Should I file for EB-1 now or wait on EB-3?

I’ve been in the U.S. for 8+ years (came on L1 → L1A → now H1B, currently on my 3rd extension). My PERM and I-140 are filed under EB-3, with a priority date of Sept 6, 2023. Right now USCIS is only accepting AOS for PDs of Apr 1, 2023 or earlier.

I’m 38, from Brazil, with a solid career both abroad and in the U.S. I’m confident I meet at least 5 of the 10 EB-1 criteria and could get strong letters and supporting material. EB-1 is current. Please help

Forgive the basic question but can you contract around state statutes? For ex, customer wants to insert state contractor payment statutes and have that state law govern. I’m assuming the way around this is to have another more preferable state as choice of law?

My firm has applied for my L1A visa. If that gets denied, my plan is to travel to Canada and re enter US immediately on B1/B2 visa (already have valid B1/B2 stamp) so that I'll get time to figure out things here in the US (sell my stuff, handle my bank accts etc). - I didn't get selected in the H1B lottery.
- My company has agreed to send me to their London office for a year (haven't yet filed application).
- OPT ends in late June, so I can stay till mid-late August (grace period).

Question:
Should I just move to London as soon as I'm able to, or is it worth waiting until the end of my OPT in August in case they do a second round of the H1B lottery?
