1. At the end of the day it's a just a power pull from state gov to take away big commercial cases from liberal judges in the big cities.
2. Some local district court judges in Texas are God awful and totally unqualified (I guess that's what you get when you have partisan elected judges). HOPEFULLY we can actually get some qualified judges who can handle these cases on a timely docket
I'm pretty liberal personally but do support the business courts. I expect that on average, the judges here will be better because they have experience with complex litigation.
As for clerking, hell no. Maybe one day they get the prestige of DE Chancery. But unless that occurs, I'd pretty much never recommend clerking for a state court that is not the TX Supreme Court.
No my view wouldn't change. The only clerkships I would recommend are federal district and appellate courts, state supreme courts, DE chancery court, and bankruptcy court if you want to be a bankruptcy associate.
Clerking is almost always a good opportunity.
The courts were created by Texas legislators to please their big donors. The liberal judges in the big cities are largely former plaintiffs’ lawyers who don’t care about following the rules of civil procedure.
