The adoption of the commercial part rules? I’ll believe it when Kings CCP actually enforces them
If you practice in federal court they're not all that groundbreaking. They were pretty much put in place by the commercial part lawyers because they're largely federal practitioners and were trying to make NY more like federal court. The problem is that federal court has much more time to manage cases. Who's going to supervise all this stuff? If it gets enforced, I think it's much worse for defendants than us. Cuts down on a lot of billing opportunities IMO.
If the courts actually enforced the CPLR it’s not a problem. I just feel like I’m going to be laughed at by a clerk when I point out how my adversary has failed to comply with the new rules.
Even with the old rules, discovery motions routinely lacked a necessary affidavit of good faith, courts were directing plaintiffs to file notes of issue with all discovery outstanding, it’s a mess.
The supreme court (in all boroughs) is a mess. It's so outrageous
