When a position is advertised with salary being performance-based, does that mean there'll be a base salary and upwards of the base will be performance-based? This position is for a Junior Attorney so somewhere in my head, I'm thinking it can't be that the entire compensation is performance-based. I know performance-based salary structure is common/can be ideal for partners, but is this ideal for junior attorneys? Should this be considered a red flag? Your two cents are welcome.

How many billable hours per week is considered at capacity? I’m getting pushback on boundaries I’m setting about additional matters and marketing work from my firm when I’ve been billing 60-75 hours per week for the last 6 weeks, and I’m still behind on my work. Negotiating a settlement. I’m at $10k, opposing counsel is at $20k. My client won’t go higher than $15k. OC has come down to 17.5k and says his client won’t budge from that. Do I offer 12.5k so we can hopefully meet in the middle at 15k? Is that how the settlement game is played? Seems dumb we can’t just say let’s meet in the middle now and be done with this.
