I think the point that we are trying to make is that federal law should just go ahead and fix the problem instead of leaving it up to 50 individual states to do it.

There is no federal law requiring any special steps for private transactions. States set their own laws. For example, in Ohio, there is no background check required for private sales, and the only requirement is that you must not knowingly sell to someone who cannot own/posses a firearm.

Pwc1, why don't you go ahead and sit the next few plays out. You can totally buy a gun from a private owner without the other person having to do the name due diligence as an FFL holder.

Here, let me just paste some text that I copied from the ATF's website. "Any person may sell a firearm to an unlicensed resident of the State where he resides as long as he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law."

@D3 you are a retard. They already require that. For online sales the gun has to be shipped to a licensed dealer by a licensed dealer. Let me spell this out for all of you uneducated jerks. If person A post a gun sale online and person B wants it. Person B goes to a licensed dealer. Asks if it is ok to do the transaction through the store. Person B's dealer agrees and has person B fill out a background check. They fail it's over, they pass then ok. Person A has a licensed dealer perform the necessary steps to send the firearm to personB's dealer. Person B dealer receives the firearm and reviews it to make sure it is an allowable firearm by federal law. If it passes then person B comes and gets it.

Meanwhile, I can't even fucking open another Chase credit card because of the 5/24 rule they have...

Online of course typically you need to go through the transfer process because you are likely crossing state lines. And even if not web based transactions are regulated as interstate commerce even if they occur between two parties in the same state

The background check obviously do not apply to all situations, so why do you keep repeating yourself when someone brings new information to the discussion? I don't care about semantics of whether something is a "federal crime". The fact that you can only charge such federal crime when someone is caught using an illegal gun is the most concerning. I am arguing for preventative controls because it will save lives.
