Any advice for lateraling into a plaintiff’s law firm as a big law associate not currently doing litigation? I’m pretty sure I’d be able to learn fast since it’s what I want to do, but every position I see requires some sort of prior experience.

Can you do some pro bono litigation or some lit case for a bit to get some experience? Plaintiffs firms can have higher expectations on associates to lead deps, draft motions, and negotiate discovery because our teams are much smaller. There’s not a lot of handholding. It can be overwhelming even for big law litigation associates, because the responsibilities/expectations are like jumping up in class years.

You’ll need to demonstrate why you want to do plaintiffs work in your cover letter/interviews.

I transitioned from big law and now do hiring for my firm, but we can be skeptical of people who might just be trying to escape big law because they’re burned out. Not having any litigation experience at all would raise eyebrows.

First- are you willing to take a pay cut? Only partners generally earn big law money. Second- doesn’t matter re experience. Just start applying. Every PI and ID outlet is looking for bodies.

My dilemma… I am an injury adjuster at a carrier experiencing high inventory that’s barely manageable. A competitor offered a higher salary and manageable workload. BUT, I would like to get into underwriting. I applied for UW position w/ a different carrier and they’ve made an offer. It’s lower than my current salary and significantly lower than what I’d make by taking the first offer. Do I take the high salary and stay in claims or go for UW in hopes it will be best in long run?

Clawback clause in current contract: been in role for over 2 yrs, it was an internal move that required relocation. Relocation was approved shortly after (over 2 yrs ago) but covid meant the actual move and start of my contract with new subsidiary was delayed, I was paid by the previous subsidiary meanwhile. I got small relocation package. Would internal move be subject to a buy-out/clawback clause if I leave now and if yes, is it time in role or time under new contract? Any experience? Thanks!

When you send opposing counsel interrogatories and requests to produce, do you sign them or just include the typed signature Atty information at the bottom. I keep seeing some signed, some not signed. What is correct?

Would love to know what other Plaintiffs attorney thoughts are regarding Mercury. I practice in CA, and it’s generally known that Mercury is terrible in terms of settling. Liability not at issue? Meds reasonable? Fanf**kingtastic, let’s not settle and spend money and time on mediation. Just wondering, do PI attorneys from other states have similar thoughts vis a vis Mercury? Or is Mercury just flipping the bird to all Californians to spite the 20+ million fine CA has imposed?

Any tips on how to make our clients appear more likable at trial? Some clients just don’t give off that warm and fuzzy vibe.
