You should look up the equivalent violation under Texas Law and determine equivalency. (As others have stated most traffic violations are considered Class C).
Should not be an issue if they are truly traffic type infractions. The term "Class C misdemeanor " only applies in Texas. Even if your state did use the term "class c misdemeanor " it could potentially have a totally different meaning than Texas. They want you to apply the Texas definition . . . If there were any offense where it was unclear where it lines up (for instance a servere moving violation like reckless driving maybe) just go ahead and disclose out of caution. Your 10 mile over speeding ticket isn't what they are looking for though
I wouldn’t list those but when I was filling out my Texas bar application, if I had questions and wanted to stay on the safe side I’d message my analyst and she was always super helpful.
Oh okay - gotcha. Then I probably can’t offer much help as I didn’t want to wait until I could admit on motion and just took the bar :) Good luck. Hopefully you can resolve those two issues.
You can add an addendum somewhere explaining that you have traffic violations in X state and that you’ve intentionally omitted them when answering Question X because your understanding is these would be the equivalent of Class C Misdemeanors in Texas. You might also add that you can provide additional information related to these if requested.
Then move on with your life.
Appreciate it, thank you
Have you looked at TX law to determine how they define a class C misdemeanor and then filled it out accordingly?
Infractions are lower than misdemeanors. I would not list them. But agreed with AGC, if you have a question on how to answer, contact the entity that handles bar apps and ask. The IL app does not have any carve outs for traffic tickets so I called my examiner because I had a traffic ticket from like 15 years earlier and she emphatically told me not to list traffic tickets.
I basically looked through Texas traffic rules/violations and decided whether tickets I’d gotten fell into the exception or not (even though my home state didn’t have such categories). I was pretty sure they did, so I didn’t list them. Passed Texas C&F just fine.
No this was my initial Bar app out of law school.
