Current and former patent agents out there, how did you get your first job? Seems like a lot of law firm jobs want experience.

I found that a lot of places wanted to be sure you were really serious about working in the field (as opposed to "i hate bench science" or similar). Have you passed the patent bar already? Do you intend to go to law school?

like

Thank you! Yes I passed the patent bar. I plan to start to law school at night in 2 years. Do you think it's important to stress the plan to go to law school? I was worried it could work against me.

like

The patent bar should help - shows you are serious.

Is it a viable business opportunity for a mid level patent litigation associate to leave BigLaw and consult? Service could include pre-litigation diligence (e.g., pre-litigation infringement analysis) for funding companies and law firms, overflow work, consulting for patent prosecution firms that take on ipr or litigation work, litigation consulting for tech companies that don’t have in-house counsel. Cross posting this in the BigLaw bowl.

Although I know you don’t need to pass the patent bar to “technically” do patent litigation, would it be a dead end move to pursue patent litigation without a technical degree / admission to the patent bar? In other words, would most BL firms refuse to staff associates on patent litigation cases if they don’t have a technical degree?

Currently a trademark prosecution attorney that does some trademark / copyright litigation.
