Never done that before, part of in house counsel’s job is to be able to gauge the competence of outside counsel, and we should be good enough to do that without testing them. I will, however, ask some pretty pointed questions during intake calls to see if they know what they’re talking about.
On the other hand, if I ever find myself working with a couple biglaw firms again (won’t name them here), I will test them as much as possible because some of the attorneys I’ve worked with at those firms are utterly incompetent.
Why? What did they ask you to do?
I don't want to doxx myself but the partner thinks it's a fake test but still making me do it despite that we are genuinely drowning in real work we are getting paid for
no because that’s unethical and also kinda psycho lol.
@A5 making us turn our attention away from actual emergencies to address a fake one were not getting paid for is pretty bad
Lol, what?! As if we’re not all stretched for time as it is. I understand sending a lower priority or value task initially, but to send a fake task - that’s crazy. Lol!

yes we will send them on a date with one of our attractive coworkers to see how much client service they can provide
No. I don’t have time for that kind of nonsense.
I may interview a couple options for outside counsel before I select who we’re going to go with, but the issues or lawsuits I’m talking about are real.

Youre crazy. I like you but youre crazy
Wait, this post isn’t a joke? Can you elaborate on tests/fake tasks?
Absolutely not. I wouldn’t waste anyone’s time with fake work. I work with incredibly competent attorneys at well known firms. I’m usually working directly with a partner & whatever associates they choose. If the associates seem to be unqualified or don’t produce work that I believe is up to standards I address it with the partner assigned. But since it’s normally coming from the partner it tends to already be up to standards before coming back to me.
No. I don’t have time for that, and I don’t work with outside counsel that I don’t already know can do the work to the level I need for the particular matter.
If what you mean is asking your views of a matter as part of a beauty contest, I don’t do that but it’s unfortunately not rare.

Jfc, what in the world?
Never
Not exactly, but I have sent prospective firms some real tasks that had minor significance in reality, but exaggerated their importance to the partner in charge. I wanted to see how they would perform in fire drill circumstances. Real tasks for real fees, but fake rush.
The fake rush imo isn't cool though. What if they have a real rush like trial that week but take shortcuts to get both things done, but wouldn't have had to otherwise
